Terms of Service

Draft as of 6 Nov 2026 – will be legally reviewed and completed with the provider's details (see Legal notice) before the public launch. This English version is a translation for your convenience; the German version is legally binding.

1. Scope and provider

These terms apply to the use of Round Tonight on the web (roundtonight.com) and in the apps. The provider is the operator named in the legal notice (contact: hello@roundtonight.com). By signing up you conclude a free contract of use with us; purchases (credits, passes, regular's pass) are separate contracts under these terms.

2. What Round Tonight is

  • Round Tonight brings together people who want to spontaneously meet for a drink at a bar: in rounds with a host, at scheduled meetups without a host and at events by venues. We are only an intermediary, not the organiser of the meetups.
  • Bars and venues are independent of us. You order and pay for food and drinks directly there; the venue is responsible for offers in events. Round Tonight doesn't sell alcohol.
  • We don't guarantee that a round or meetup will happen, that a host will accept you or that others will show up.
  • The web app needs your location to show rounds and meetups nearby; it can't be used without permission.

3. Account and minimum age

  • Round Tonight is for people aged 18 and over only. When signing up, you confirm your age with your date of birth.
  • One account per person, registered with your own email address (no disposable addresses). Your details must be true; a nickname is fine.
  • Keep your device and sign-in secure and never share codes.
  • You can delete your account in your profile at any time. Any remaining credits and passes then expire; there is no cash payout.

4. Rules for getting along

  • Zero tolerance: we don't tolerate objectionable content or abusive behaviour towards others. We usually remove such content within 24 hours of a report and suspend the accounts responsible.
  • The community rules apply. In particular, harassment, threats, discrimination, unwanted sexual advances, spam and advertising, fake identities and anything illegal are prohibited.
  • Texts others see (name, bio, round titles, chat, event titles and offers) must follow these rules. An automatic filter checks them before they're saved; our moderation team reviews reported content by hand.
  • You can report people, rounds, messages and events and block people. Report illegal content with the reason “Illegal content” and a short explanation. Depending on severity we remove content, cancel events or suspend accounts.
  • How we moderate: an automatic filter rejects texts with insults, links or contact details when they're saved. Our team reviews reported content by hand, usually within 24 hours. If you report something, you see the outcome under Profile → My reports.
  • If we remove something of yours or suspend your account, you'll find a statement of reasons in your profile (what, why, on what basis). You can object there within six months; we review again and tell you the outcome. You can also turn to a certified out-of-court dispute settlement body or a court.
  • Invitations: you can invite up to 2 friends per round or meetup via a link. Only share links with people you know; the same rules apply to invited people.
  • You grant us the right to display your content within Round Tonight as far as necessary for the service. We acquire no further rights.

5. Credits, passes and prices

  • You use credits to join rounds, meetups and events (2 credits). For rounds they're put on hold when you request and only charged when you're accepted; without acceptance within 15 minutes or if declined, you get them back.
  • For meetups and events they're put on hold when you sign up and charged 60 minutes before the start if the meetup goes ahead. Until then you can cancel for free; if the meetup is cancelled or you don't get a seat, you get them back. After they're charged there's no refund, even if you don't show up.
  • Purchased credits don't expire. Free credits (starter bonus, launch-phase package, host, captain and invitation bonus) expire after 60 days and are used first.
  • Launch phase: if your available balance is 3 credits or less, you can claim 100 free credits at no cost; they expire 60 days after claiming. This is a voluntary offer without legal entitlement that we may end for the future at any time.
  • The night pass is valid for 24 hours from purchase, the weekend pass for the respective weekend. While a pass is active, joining costs no credits.
  • Credits and passes are personal, non-transferable and are not paid out in money.
  • All prices are final prices including VAT where applicable. The prices shown before purchase apply.

5a. Venues and events

  • We can link the operator of a venue to their app account; they can then create events for that venue. Operators are additionally bound by the partner terms (Legal → Partner terms), which they accept in the app before creating events.
  • Events must be real and take place at the venue. The venue is responsible for titles, offers and their legality (e.g. youth protection, price information, restrictions on advertising alcohol).
  • The number of events per month depends on the partner tier. We may remove or cancel events that violate these terms; guests who signed up then get their credits back.

6. Purchase and payment

  • You choose a product, agree to immediate delivery and click “Order with obligation to pay”. This is a binding offer; the contract is concluded once the payment is confirmed.
  • Payment is processed by Stripe (Stripe Payments Europe, Limited, Ireland), e.g. by card, Apple Pay or Google Pay. Payment details never reach us.
  • Purchased credits and passes are available in your account immediately after payment. Stripe emails you the receipt.
  • In the iOS and Android apps, Apple's or Google's terms additionally apply to in-app purchases.

7. Regular's pass (subscription)

  • The regular's pass runs for one month or one year and renews automatically for the same period at the then-current price unless you cancel.
  • You can cancel at any time to the end of the current period – online via “Cancel contracts here” under Credits or by email. Periods already paid aren't refunded pro rata.
  • We announce price changes at least 30 days in advance; they only apply from the next period, and you can cancel before then.

8. Right of withdrawal

  • Right of withdrawal: As a consumer in the EU you have the right to withdraw from a purchase contract within fourteen days without giving any reason; outside the EU we voluntarily grant you the same right. The withdrawal period is fourteen days from the day the contract is concluded.
  • To exercise your right of withdrawal, you must inform us (provider as per legal notice, hello@roundtonight.com) of your decision to withdraw from the contract by an unequivocal statement (e.g. by email). The easiest way is the “Withdraw from contract” button under Credits (or at the bottom of every page) – you'll get a confirmation of receipt right away. You may also use the model withdrawal form below, but it's not obligatory. To meet the deadline, it's sufficient to send your notice before the withdrawal period has expired.
  • Effects of withdrawal: We will reimburse all payments received from you without undue delay and at the latest within fourteen days from receiving your notice, using the same means of payment you used; you won't incur any fees. If you requested that a service (e.g. the regular's pass) begin during the withdrawal period, you pay a reasonable amount for the part already provided until your withdrawal.
  • Expiry: For digital content (credits, passes) the right of withdrawal expires once we begin performance after you have expressly agreed that we deliver before the withdrawal period ends and acknowledged that you thereby lose your right of withdrawal (Art. 16(m) Directive 2011/83/EU). We ask for this consent before every purchase. For services it expires once we have fully performed them (Art. 16(a) Directive 2011/83/EU).

Model withdrawal form

(If you want to withdraw from the contract, please fill in this form and send it back.) To: provider as per legal notice, hello@roundtonight.com – I/We (*) hereby give notice that I/We (*) withdraw from my/our (*) contract for the purchase of the following goods (*)/for the provision of the following service (*): … Ordered on (*)/received on (*): … Name of consumer(s): … Address of consumer(s): … Signature of consumer(s) (only if this form is notified on paper): … Date: … (*) Delete as appropriate.

9. Suspension and termination by us

  • If you breach these terms or the community rules, we may remove content, cancel events, restrict features or suspend your account temporarily or permanently. We take into account the severity of the violation and your legitimate interests. You can send us questions and objections about a decision at any time; we'll review it again.
  • We may terminate the free contract of use with 30 days' notice, or without notice for good cause. If we close an account through no fault of yours, we refund unused purchased credits and the unused part of paid passes.

10. Safety and liability

  • Meetups are at your own risk. Meet in public places, drink responsibly and look out for yourself and others. You'll find tips on the Safety page.
  • We're not responsible for the conduct of other users or for bars. If something goes wrong, please report it.
  • We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable for breaches of essential contractual obligations, limited to the foreseeable, typical damage.
  • We strive for uninterrupted operation but can't guarantee constant availability, e.g. due to maintenance or third-party outages.

11. Changes to these terms

We may change these terms if there is a valid reason (e.g. new features or changes in law). We announce changes in the app at least 30 days in advance. If you don't object, they're deemed accepted; we'll point this out in the announcement. We won't unilaterally change essential terms such as the prices of products already purchased.

12. Dispute resolution, governing law

  • We don't take part in proceedings before a consumer arbitration board. If you have a problem, please contact us directly.
  • German law applies. If you're a consumer, you keep the mandatory protection of the laws of the country where you habitually reside.
  • If any provision is invalid, the remaining provisions remain in effect.
